Can a bill collector put a levy against a bank account?
Anonymous2 views1 answers
My parents stopped paying on their credit cards 2 years ago and last week their bank was emptied to (-) negative $44 by a levy that so far, we do not know what from, the bank will not say who, only that it is court ordered. What NJ law would require the bank to disclose the city name or a copy of the court documents?
Also, can that same levy be applied to any stock/bond monies? I pulled their credit report, those cards show as charge off, how can a creditor list the debt as a charge off (for the tax benefit) then sell the debt? If the ownership of their bonds is transferred, will that shield them from a future levy?

You really need to spend a little on a consultation with an attorney. It seems like they may need a bankruptcy or other protection and it sounds like they may have judgments against them.
My standard disclaimer: I am not offering legal advice or services, assume all of my advice is completely incorrect, assume I do not know the law in your state and assume that I am just making suggestions for starting points for when you do speak with an attorney. Do NOT rely on anything I write and contact a lawyer in your area immediately after reading my posting.
