What do I have to do to sign my rights over ?
Anonymous2 views3 answers
Because I pay child support and I haven’t seen my kids in like 4 to 5 years. My kids mom block me from calling them so I can’t even see them or talk to them so I wanted to sign my rights over

You cannot. Only in the case of an adoption can you do this. The law requires you to pay support even if you choose not to visit. I say choose because it is up to you to file a petition to legitimate the children in the superior court if you want visitation. Before you do this, the law does not require Mom to participate on allowing you visitation. Step up and file. Then visit.
This question is being posted a lot on this site, and it arises from a street myth. You cannot “sign rights over” to children outside of an adoption situation, when parental rights are being surrendered as part of an adoption proceeding.
There’s no way to sign your rights over. You could give up rights to them if she were to re-marry and the stepfather were to legally adopt them. Do you want to see your children? If you have a court order giving you rights to see them then she can’t block you from calling or seeing them. She would be in contempt. You should meet with an attorney who can review the facts of your case and help you address this legally so that you can see your children. If you were never married before then you will need to go through the legitimation process so you obtain legal rights to the children. Until you do that you have no legal rights to them and she can get away with what she’s doing.
