Duty to preserve police evidence?
Anonymous2 views2 answers
Is there a federal statute (or state arkansas) that requires Cities to preserve police body cam footage, police interview recordings and security camera footage.

This varies from jurisdiction to jurisdiction within the State of Arkansas, and even from Judge to Judge. Generally, I file a motion to preserve evidence within 30 days of arrest. IMO, this puts duties beyond the Brady case to the State. While Brady says the State has a constitutional duty to hand over exculpatory evidence, videos can get deleted due to "document retention policies." You need to immediately contact a proper criminal lawyer. Especially right now with the coronavirus and court closures, I (and everyone else) am having difficulties with the court system and getting things done. It is not the time go tread alone. Good luck.
