It's hard to say what's really going on without knowing whether DHR has filed a case with the Court's and what, if anything, has happened in that case. If Dad is on the birth certificate and there's no court order whatsoever then he may have every legal right to simply go pick up his child. BUT, that's a bold move and there is no good way to do that without a lawyer. He does have a 4th amendment right to refuse the drug test, but that's another bold move. We do it with our clients at times but that's with a full understanding of the procedural and factual situation and the readiness and willingness to defend our decisions in Court if DHR wants to dance. Good for your side for getting moving on this this early in the game. Please talk with a lawyer in your area or book a video / phone call with one of the attorneys on this site to get more details and options. DHR's involvement makes the situation much more complex. I would not advise anyone to try to deal with DHR without the advice of an experienced attorney. Mr. Williams has given you good advice. Hire a lawyer as soon as possible.
