I want to sue my property manager for breach of contract and neglect but I live out of state. How can I do this?
He advertised, among other services, periodic property inspections. After a year, the tenants, who have since moved out, wrecked the place. When I asked the property manager if he had every done an inspection he said no, that an internal property inspection are done at an additional fee. No where on the marketing material or website does it explain that inspections are additional. I gave him a 30 day notice to terminate our agreement and told him I will be flying to TX to get my gate card and garage door remotes. He said he will not give me anything until I pay the final bill. My questions are: Can he hold my property when he hasn't provided me with a bill? Can I sue him for the full years management fees I paid and for the damages the tenant made? I do have the security deposit already.
