Buddy's Home Rental cannot take you to jail. They can file a police report and if the cops find probable cause that a crime has been committed then the cops can arrest and take you to jail but Buddy's Home Rental cannot. What Buddy's Home Rental can do is to sue you and seek to repossess their property if you breached the contract. Wishing you luck and hoping that I have been helpful in answering your question.

You agreed to rent the equipment, not purchase it. If it is gone, destroyed or damaged, you could have legal exposure - civil or criminal. Best to get an attorney involved early.

"I just need help figuring out they say my count as a delinquent or some crap like that" with THAT view of the world, this is why Fla. Stat. 812.155 exists, The "crap like that" is YOUR responsibility to know whether you are paying as you agreed and its a pretty good bet we ALL know the answer to that. That stated, no RTO place can arrest you criminally themselves. HOWEVER if the "crap like that" includes a claim they sent a statutory demand letter that you return the items rents or pay them off, then the "crap like that" will include criminal prosecution by the State Attorney. Failure to return or pay off the items at issue after that letter is sent makes it a PRESUMPTION that you intended to defraud them out of the items and most areas quickly file such charges for that reason, and when you cry foul about it...its thier turn to say "whatevah". If you aren't paying for the items bring them back, immediately, at your expense.

They can file a criminal complaint, and the state attorney will determine if charging you with a crime is appropriate; and they can file a civil complaint as well. My suggestion would be to pay your bill, or return the furniture ASAP. hope this helps. gsg
