What money am I entitled too when someone hits and totals my car while getting a ticket for wreckless driving?

Apparently he was texting and didn't even slow down before totalling my car from the rear. The insurance recently decided that it wasn't worth repairing and I'm waiting for thier offer. I figure that I'm owed the kelley blue book value of the car plus tax but I don't know. They've accepted responsibility and given us a rental until things get settled. I would appreciate any legal advice. Thank you in advance.

You will get fair market value, which is probably less than you want. If you were injured, you can call a local personal injury lawyer to get you money for pain and suffering.

You definitely need to talk to an attorney to find out the full value of what is due you. You are entitled to, among other things, the full value of the damage to your vehicle, payment for any medical bills (you didn't say whether you were injured), your loss of use of the vehicle, time off or loss of wages for time you had to spend away from work, pain and suffering if you were injured, etc. Whatever you do, do not sign any releases from the insurance company. It may be that the insurance company will make everything right with you, but my experience is that they are out to make money and they will try to get you to agree to the bare minimum of what you're entitled to. Talk to a lawyer. Most will provide a free consultation.
