What Recourse ? - Neighbor's Neglect & Abandonment results in Rats

3 views 1 answers
I live in a Townhouse with a HOA. My neighbor has not lived in his unit for more than 3 years. The property is infested with rodents. He refuses to take any further action. HOA has been of no help. City code says unless rats are outside they have no authority. I want to force him to clean it up or sell ? Do I have any cause of action. I have spent over $1,000 to repair my bathroom a year ago.

This is a tough one. Yes if proper steps are taken you could probably try to recover from this abandoned neighbor however on the other hand this neighbor probably abandoned the property because it's in foreclosure or will be in foreclosure which means the chances for judgment recover are slim. It's one of those situations where you will probably have to spend a few hundred dollars to take precautionary measures which in the long run would be cheaper than hiring and attorney and or suing.
