I was out of electricity for two days andthey said they would not compensate me. I feel like just putting the next rental payment into an escrow fund, and explaining the sitiuation in court. Will I have a chance to explain in court, or due they just post notice of non-payment and barge in.?
Make certain that you send the correct statutory notice and send it certified mail return receipt requested. This "repair or Tenant will consider the Lease agreement terminated" should comply with Florida Statutes 83.56 subsection 1. Link is below.
The LL must post or serve you a 3-day notice for non-payment of rent prior to starting an eviction lawsuit for unpaid rent. On the 4th day after the notice is posted, the LL can file the eviction lawsuit in county or circuit court, depending on the amounts owed.
When an eviction lawsuit is begun, the process server / Sheriff's Deputy makes an attempt to reach you by knocking on the door/ringing the doorbell. If no one answers, they come back for a second attempt. If they still cannot reach someone, they tape it on the door (a/k/a posting). At the point that you are served or the summons is posted, you will have five days (five business days) to bring your "Answer" to the court. You can ask the judge for a hearing in your Answer. Make sure to attach a copy of the letter you sent the LL asking for repairs.
Good luck! If my answer was helpful, please give me a vote up. Thank you.
