Hi, am on H4 visa n my husband on H1. even though it's a short time since i arrived here, i don think our marriage will work out. i know my H4 will not be valid after divorce. can i apply for asylum ? am from Ethiopia.thank you in advance for the advise you are going to provide.
Generally, a person must file for asylum within 1 year of entry to the U.S (though there are a very few narrow exceptions to this rule). If you have a genuine credible fear of being subjected to persecution upon your return to Ethiopia by your government or by groups the government is unwilling or unable to control, based on your religious, political, or social attributes or affiliations (this area is generally quite extensive and complex under case law) then you may be eligible for asylum. Again, generally you must apply prior to 1 year after entry to the U.S. I highly recommend that you retain a well experienced, AILA certified immigration attorney to represent you as the asylum process can be extremely difficult and complex.
You need to retain an experienced immigration lawyer to review all the facts and advise you accordingly.
Asylum applications must be submitted within one year of entry into the US or must be based on changed country conditions. Additionally, they must be based on persecution.
