I am 1099 contract "employee". I was terminated today, July 26, 20ll. The reason, for being 8 mintues late, after NEVER being late, and informing my "employer" that I was stuck in traffic 20 minitues before. I requested my last paycheck. My employer informed me I would get it once I returned the company shirts. I made arrangements, now he is telling me I will get it this Friday. I want it NOW. I use to be EVERY Friday, then EVERY 2 weeks. What are my rights? I thought once you were terminated, you suppose to get your last check on the spot. He is playing games, telling me if I step foot on the property, I will get arrested, I am harrassing him...all I asked for is my check, only once. What are my rights as a 1099? Please help!!!

You should consult with an attorney in your area. It sounds as though you may have a valid claim not only for your last paycheck, but also for being misclassified as a 1099. If you were misclassified, you may be entitled to remedies such as unpaid overtime (if you were not paid overtime), withholdings that should have been made to social security and other similar items, as well as other penalties and wages that may be owing to you.
