Petty theft of less than $400 is a misdemeanor, carrying a possible maximum of six months in county jail and/or a fine of up to $1,000. There is a lesser crime (Penal Code section 490.1, an infraction) for theft from a retail store under $50. The D.A. does not have to charge you with the infraction, but your attorney may be able to either get the charge reduced or try and get it dismissed.

Get a good lawyer to either get the charges dismissed through what is called a diversion or reduced to an infraction. A theft conviction, even if for a misdemeanor petty theft, will greatly complicate your chances of seeking and getting employment in the future. You should do everything you can to avoid it.
