Question regarding temporary guardianship of a disabled adult

4 views 1 answers
I just have a quick question that I hope you can answer. My mother is the guardian/trustee of my mentally disabled sister. She is 46 and has the mental capability of an 8 year old. An issue has happened and my mother and I are wondering what type of form, or letter would be needed to give me emergency guardianship of my sister, including her assets/money in case something happens to my mother. I will already have power attorney over my moms assets and health care. We just need something to protect my sister(disabled) from another sister who will do anything she can to take the disabled sisters money. This would be needed until I could get guardianship of her Thank You

Generally, a guardianship will have a provision for what happens if the guardian becomes incapacitated. If the guardianship paperwork that your mother has does not provide for what happens if she becomes incapacitated, you will likely have to go through a guardianship proceeding similar to what your mother went through when she became your sister’s guardian. If you need more information, you should contact a guardianship attorney licensed to practice in Wyoming.
