My foreign spouse wants to divorce me after NOID?

2 views 5 answers
My foreign spouse had a b2 non immigrant visa for tourism in America since her arrival November 2019.it’s now expired since May 2020 we got married December 2019. We got married went to 2 interviews they were bad and our petition I-130 got a NOID. The NOID says we were unable to prove marriage is bona Fife and they suspect it’s a SHAM marriage. Turns out I’m still married to someone so that makes her marriage invalid to me and she’s not able to get green card. She is furious! She has a immigration lawyer now and is going to divorce me and her excuse is that I lied about not being married and am still giving my ex money. Can the lawyer get her the green card another way when she becomes single. She has no status here if she divorces me right? Will immigration wonder why this foreign quickly divorced the US CITIZEN when the petition 1-130 got a NOID ? Can she get asylum or what can the lawyer be able to get her? It seems obvious she’s here to evade immigration laws

To answer to your questions, it appears she found out you were a criminal (a bigamist, at a minimum) is seeking a divorce or otherwise to have the marriage invalidated and has obtained her own immigration attorney. Her odds or status as an immigrant are no longer any of your concern, you have much more to be concerned about now. Peace be with you, and may love guide you. Since you had a sham marriage, that would preclude her from VAWA relief, but more investigation would be required. This is a very unique case. If you were already married when you married her, there was no marriage, so she's not really your concern. However, if I were you, I would hire an immigration/criminal defense attorney: bigamy is a crime.
