I paid a speeding ticket back in march that i got in virginia. A week ago I received a letter from the court in Virginia saying that there was a hearing and that I had to appear regarding the speeding ticket. I called the court and they said a lawyer in nj opened the case in my with my case number so I called the lawyer and he said that he was representing a jeff Bongiovanni my name is Joseph Bongiovanni so there was some kind of mixup so I called the court back and they said I had to send a letter but why is the onus on me to straighten this out? The onus should be on the court and the lawyer who the court said opened this case using my case number, right? something seems fishy to me... lines got crossed somewhere but the court wont call this lawyer to straighten this out!

The onus is on you to straighten this out because if you don't, then you'll get hauled into court on an arrest warrant or you will have your license suspended. So, it's a pain in the patoot, but you'll have to figure it out. And it's almost never as simple as a phone call. Good luck.

Unfortunately mistakes happen. It may be fishy to you, but it sounds like a common clerical error to me. So, just do what you have to do, write the letter. If you still have it, send a copy of the check you used to pay the ticket. Make sure to include all the relevant information that you can: date, time, place of the ticket, payment type, your car, registration/plate number, etc. If you still feel vindictive or outraged, blame that attorney that opened the case, not the court. Tell him that you are considering reporting him to the State Board of Bar Overseers unless he fully clears your name off this court action. To assure that this is done, demand copies of the case resolution.

Take your head out of a certain part of your body. The onus is because you are the one that needs the help. What does the court care when you are arrested for this? They know that the matter, at that time, will be dismissed so what difference does it make to them. YOU, on the other hand, should be terribly concerned and want to make sure everything is done properly, So do what you were told and get the matter over with.
