My father has stage 4 cancer and he has 1 month.I have to leave the country to see him no matter what, but I have a bench warrant for driving with a suspended license which is a misdemeanor warrant I have issued since 2005 in North Carolina I currently for the last 6yrs live in Miami,Fl.I am flying international threw Miami to Spain and i would like to know if I will be arrested or stopped on the way back into the country since the warrant is in North Carolina and I'm coming back in threw Miami and Im not sure if they extradite.I've been pulled over an even went to jail one time and I never had a problem with this warrant.I'm a U.S. citizen.I called several lawyers to resolve this but they all want $1200 plus for this and I don't have this type of money so any info will be of great help.

You may have some issues at the airport. However, it all depends on the CBP's officer. Believe it or not, I've had clients with outstanding "in absentia" deportation orders who have come in and out without any problems. You should go to NC and resolve your issue or hire an attorney to do it for you. Sent on the Sprint® Now Network from my BlackBerry

In the case of a warrant upon application for admission, your immigration status is irrelevant. If CBP becomes aware of an outstand warrant they will detain until the agency responsible for the warrant decides whether they want to come and get you. Sometimes those decisions are made quickly, other times not so. Thus, it will most likely be up to the Sheriff of the County where the bench warrant was issued to decide if they want to extradite you (there is extradition between all 50 states). This is the risk you take for being irresponsible for the last 6 years. Do yourself a favor and find the money to hire an attorney to clear up your criminal record.

Can you be arrested? Yes. Will you be arrested? We would need a crystal ball to answer that.
