for a first time dui, will attending a DUI school or counseling prior to sentencing help influence the turnout in order to get the minimum sentence? this was in cook county
In my experience as a former Prosecutor most judges and Prosecutors favorably view any Defendant who is proactive in taking rehabilitative action before sentencing or a plea even. The fact that so many defendants do nothing makes those that do really stand out positively. It costs nothing to go to AA/NA meetings and keep a log showing you are addressing your issues. Once you get an evaluation from the acceptable court mandated agencies there is no reason you cant start right away before you plea guilty or are sentenced. In fact it clears your calendar for other things you will be needing to do such as community service in some cases, attending a victim impact panel, and hopefully working at your job to pay off your fines and court costs in a timely manner.

The answer is mostly going to depend on the specific facts of your case and other background. But you should know that as a condition of any sentence on a DUI you will have to have an alcohol/drug dependency evaluation and then comply with all recommendations of the evaluator including classes and possibly treatment. Whatever you do now, won't count toward those requirements in most cases and might possibly result in your receiving a worse evaluation. Only in limited circumstances would I recommend you do this on your own before appearing in court. You need to discuss it with your attorney; if you don't have one, you need to retain one now.
