Completing Sworn Financial Statement for divorce in CO

Business Questions 3 views 1 answers
I am in the process of completing my Sworn Financial Statement for my divorce. The SFS requests information regarding my current financial status. But this will change in a matter of months as I am in a temporary housing situation where I do not pay rent or utlities (my daugther and I are with my parents). I may not pay rent now, but I will. Same with other household expenses. Do I complete the Statement with what I WILL pay or what I paying NOW? Won't this affect me as the courts look at if I qualify for alimony & other financial matters? Also, if my husband doesn't provide the required information by our filing deadline, how will the courts handle? He hasn't filed our taxes since 2007. The judge at our ISC strongly "encouraged" him to complete but what if he does not?

You will fill out the financial affidavit based upon your current status. You can add notes indicating the changes that are upcoming, you can file an updated disclosure prior to hearing, and you can argue to the court that different numbers should be taken into account due to the upcoming changes. If your husband does not complete his disclosures, you may have to file a motion to force him to do so. As you are finding, a contested divorce is not easy to complete without a competent attorney. If you and your husband cannot reach an agreement on all of the relevant issues, you should consider obtaining counsel. If you cannot get funds to hire an attorney, you can apply for assistance from a charity organization such as Colorado Legal Services Corporation (Legal Aid) or the Metro Volunteer Lawyers. You can find links to both organizations on my website.
