I was hit by a drunk driver and my car is most likely totaled

i ended up going to the emergency room i am experiencing some moderate neck and back ..im going to miss atleast the next 2 days of work and am without a vehicle to return to work, i do not have full coverage just liability. however the accident is going to clearly be his fault, being as i had the right of way + dui. i have his insurance info from the cop and my insurance said to give his a call since im in no wrong. i guess im wondering if i should get a lawyer or wait to see what the insurance does?
