It depends on the nerve damage and how long the symptoms will last, if you know. A lifetime? If so, your age matters. Is there chronic pain? Tingling? Further, there is no formula, the jury just makes a determination and has to put a value on your suffering. My standard disclaimer: I am not offering legal advice, assume I do not know the law in your state or at all for that matter and that I am just making suggestions for starting points for when you do speak with an attorney. Do NOT rely on anything I write and contact a lawyer in your area immediately after reading my posting.

The insurer is right. You ought not to be settling the case until the extent of permanency of the damage is known. It would be unusual for the only injury to be shoulder nerve damage. What about your back and neck? Please describe your injuries more thoroughly, and whether you have pain, tingling or numbness that travels from your neck to your arms and hands or from your back down into your legs or feet. Post again and start from scratch with more detail if you wish a meaningful response, or you can call me at 415 233-0605 for a free consultation.

First off the statute of limitations in your case is Sept. 09! If you do not file suit within 2 years, you will lose any right to collect in this case! The insurance company is trying to string you along until you lose your right to sue! What are you doing trying to handle this without an attorney. I wrote an article about this exact subject on my blog. Don't be one of those people that calls me when it is too late to help you. Bottom line, call me for a free consultation at 800-816-1529 ext. 1. Norm

My apologies. My prior post was in error. I misread the date of the accident, and therefore I agree that the adjuster is trying to make you miss the limitations date. For further information on dealing with insurance adjusters you might want to review http://negligentdeath.com/faq.htm. You definitely need an attorney for this kind of claim.
