A motion for contempt is a pleading in which a person aggrieved by the opposing party's failure to comply with court orders asks the court for relief. The court, if it finds the opposing party in contempt can order compliance and award attorney's fees and the cost of the motion. Impossibility is a defense to a contempt claim. In other words, if the reason the orders are not followed is because the person with the obligation to act could not have complied, that excuses the contempt. It may be appropriate to move to modify an order in those circumstances. A citation means that there was a pleading served on the person who is allegedly in contempt notifying her or him that there is a hearing on the issue of contempt at a certain place and time. Post judgment means after the divorce was finalized and distinguishes the motion from those directed at pendente lite orders. Contempt is a serious issue involving the presentation of evidence and having an attorney to defend against the claim would be very helpful.
