me and my husband have an interview after filing his i130 i think because we petitioned him almost right after marrying but we have one child (2 years old now) one about two weeks from meeting this world and we have a lease for our house under both our names. on top of this interview he has a pending case in immigration court, which is not because of bad criminal charges just 2 warrants he had for driving without a license when he was arrested, his court is until april 2012. he has my petition which we want approved and is i245 eligible through another petition he just out aged that one. can they deport him at this interview. is there a good chance of our petition getting approved? i my self have no criminal record and those 2 tickets were the worst he ever had.

If he has a warrant, it is possible, maybe even probable, he will be arrested at the interview. I strongly recommend you see an experienced immigration attorney in your area before the interview date. Law Office of Rogelio V. Morales 11801 Pierce Street, Suite 200 Riverside CA 92505 (951) 710-3039

If an alien presents himself at a USCIS office and the exists evidence of there having committing a crime or other violation of the INA that would make him deportable, he may be detained by an ICE officer. Most if not all USCIS offices have an ICE agent on duty. He should contact an experienced immigration attorney who can assist with a review of the facts and provide legal guidance throught the I-30 interview process.
