I basically need paper work showing that it is legal for a 15 year old to date a 20 year old in North Carolina . is it anywhere in the constitution that says that its legal , or in the nc "rule book" ?
It appears to be a Class B1 Felony to engage in intercourse or sexual contact with a person under 13, unless the defendant is less than 4 years older than the child. If the defendant is over 18, this carries a minimum 300-month (25 year) prison sentence. (Sec. 14-27.2, 14.27-2A, 14-27.4, 14.27-4A)
It is a Class B1 Felony to engage in intercourse or sexual contact with a 13-, 14-, or 15-year-old if the defendant is at least 6 years older than the child and is not married to the child. It is a Class C felony to do the same if the defendant is more than four but less than 6 years older to the child and not married to the child. (Sec. 14-27.7A).
All that said, it would appear that 16 is the age of consent, although it may be younger depending on the relative ages of the two people involved (i.e. how close they are in age).
If by date, you mean meet at the malt shop for burgers, you are good to go. If you mean anything more physical, you have to wait for the 15 year old to turn 16. There is nothing in the Constitution. You are looking for North Carolina General Statute 14-27.7A which tells us that sexual intercourse with a 15 year old by someone more than 4, but less than 6 years old is a Class C felony. A Class C felony can carry a sentence ranging from as little as 44 months minimum to 62 months maximum in prison to as much as 182 months minimum to 228 months maximum. The prison is an absolute requirement for people convicted of this charge as is registering as a sex offender for the rest of that person's life.
When the 15 year old turns 16, the 16 year old can legally have sex without putting his/her partner at risk of prison. Until then, I strongly advise you to limit your activities to holding hands.
Listen to the good advice being given. Run the other way and find someone your own age. Have you ever heard the term "jail bait"? NC has some very serious and severe laws when it comes to this. I have even seen an instance in NC where a 16 year old was prosecuted for felony charges for a relationship with a 14 year old. Although the couple did have a sexual relationship, the main problem was that the female was under legal age. There is also a felony "crime against nature" offense in NC which is not age specific.
