Aggravated DUIs are extremely serious charges and you need to retain counsel. It sounds like you have only one pending case right now? If the pending charge is an Aggravated DUI, a class 4 felony, you are looking at a prison sentence anywhere from 4 months to 3.75 years. You could also be placed on probation for up to 10 years, and a license revocation of 3 years. There are also fines of $1500, $1500, $750 plus 84% surcharge and $250. I am answering this question assuming you were charged with a class 4 aggravated DUI because your license was suspended, revoked, canceled, or refused. When your third case comes along, you will most likely be charged with 4 counts of Aggravated DUI. One count for having a suspend license and impaired to the slightest degree, one count for having a suspended license and over a .08. Another count for this being your 3rd DUI within 84 months and impaired tot he slightest degree, and a final count for being over a .08 and 3rd DUI within 84 months. There will be another set of fines as I listed in the previous paragraph. If you are convicted of the first DUI, the second DUI carries a mandatory prison sentence of 2.225 years - 7.5 years in the Department of Corrections. This amount of time you are looking at is based on you having no prior felony convictions. To help you more I would need to know your complete criminal history and the exact crimes you are charged with. I handled only Aggravated DUI cases for numerous years. I am very familiar with the court, judges, and prosecutors. You need to hire counsel to help guide you in this system and look over your case. With aggravated DUI the state must prove you knew or had reason to know your license was suspended. There are pages and pages of convoluted MVD records to look at. An attorney must make sure the police officer did not violate any of your rights and that your blood was properly drawn. Good luck, Aaron Black DUI and Criminal Defense Law Office of Aaron M. As Mr. Black indicated in his post, you are facing a significant amount of time in the Department of Corrections. If you have not already, you should retain counsel in order to review your cases. An attorney can look for legal issues that may cause your charges to be dismissed pre-trial. If you do skip town the court will issue a bench warrant for your arrest.
