In 02 I was found with a small out of marijana and asked was given Community Service Labor Program. I completed the program in 03. I was currently arrested and was asked if I had used the Accelerated Rehabilitation program. Are these two things the same? Or different? Would I be able to use the Accelerated Rehabilitation program for my current arrest?

The Community Service Labor Program is NOT the same as the Accelerated Rehabilitation program and its prior use does not make you ineligible to apply for Accelerated Rehabilitation. That being said, however, you cannot get Accelerated Rehabilitation if you have previously been convicted of a crime in CT or any other state. Also, there are a number of offenses which the legislature has determined that Accelerated Rehabilitation cannot be used for. You should at least consult with an attorney to determine if you are eligible and also, whether or not a favorable disposition can be achieved without using AR, i.e. community services hours in return for a reduction to an infraction.

Only certain kinds of offenses are AR eligible. Also, the plea that you took for the community service may effect your eligibility for AR (usually only for a first-time offender). You need to hire an experienced criminal defense attorney to help you. Best of luck. Should you have furthers questions, please feel free to contact me at the website www.aarongoldsmithlaw.com.
