Can my adult daughter get an order of protection against me?
Anonymous7 views3 answers
My 37 year old daughter who lives by herself hasn’t talked to me in about three years for reasons I’m still trying to figure out. I have tried to contact her through phone calls, emails, and letters. Her last contact was a message she texted stating that if I ever try to contact her, she will obtain a protective order against me. She is my daughter and I’m deeply hurt that she won’t talk to me. Would she be able to get a PO?
If she has asked you to cease contact then that is her decision. While a temporary restraining order might be granted, they are fact sensitive and you would need an attorney to assist you. It would be better to respect her wishes in the short term at least.

If she has asked you not to contact her and you continue to contact her that would support a charge of harrasment both as a disorderly matter and underlying a TRO.

More information is needed. And it depends. Unless you left a threatening message etc. the only underlying charge for a TRO would be harassment. So it would depend how many texts etc. there are, when they were sent, how often etc. Many variables. Depending on those facts too even if a Judge found the predicate criminal act they might not find a FRO was needed.
