If I mail a money order of 25$ for a open container in the park will it dismiss my case?

I got caught in the park with another person with an open container of alcohol and got a pink slip and a white paper with the plead of not guilty and a plea of guily therefore it would mean I have to pay a 25$ fine thats to be mailed within 10 days.

When you pay the fine, you are admitting that you are guilty, and that's the end of the matter. If you don't pay the fine, then you MUST respond by pleading not guilty or you will receive a default judgment and additional penalties will be added to the original fine. You cannot pay the fine and plead not guilty.

A plea of guilty (whether to a mere violation, as in your case, or to an actual crime) does not result in the case being dismissed any more than, say, when one pleads guilty in a criminal case and is sentenced. You can decide to fight the charge or to pay the $25; paying the file will satisfy the matter and close the case, not dismiss it. Good luck to you.

If you do this, the case will be dismissed and you will not have a criminal record.

That will finish the case with a plea of guilty to a non-criminal conviction but that is not a dismissal. To dismiss it youd have to get a hearing and push the case forward, however if you pay the $25 the case will be resolved without a record.

If this was in NYC, I don't think the Court will acept a guilty plea by mail because all crimes in NYC Parks are misdemeanors by law. Therefore, the Court will likely return your check and direct you to appear in court.
