OWi/Deferred judgement and Canada

1 views 1 answers
In July I recieved my 1st OWI (iowa) with a blow of .115. I was able to plead guilty, paid a fine, and recieved a deferred judgement.. In Iowa it is a gross misdemenor, but in Canada it is a felony and you can not enter without a complex procedure. The Question is does a deferred judgement change how Canada looks at this OWI. ie that it is not an OWI and I can still go fishing.

Well, this answer may be too late but for what it's worth. It would be very difficult to answer this without really understanding Canadian laws, or being a canadian lawyer. I can tell you for example that California has a similar statute for crimes, however this deferred judgement is not recognized, with some exceptions, by our federal government. I think, just a guess, that Canada may have a similar position. Again, to late for you now, but for others who read this the best solution is to fight and avoid conviction.
