The landlord obligation is to your ex-husband and any others specifically on the lease agreement–not to anyone else without property authority In many states, family members can get a Letter Administration issued to the legal representative of the estate of the deceased by the county Register of Wills office. The family and/or executor of a will go to the Register of Wills and open the estate to obtain these documents. This should suffice for the landlord to allow access. STRONGLY recommend you speak with a Missouri probate/wills/trusts attorney as the laws in these areas differ state by state. Use the attorneyqna.com search option or call your county bar association and request a referral.

The prior attorney offers sound advice. The point here is that when someone dies without a will no one can act for him until an administrator is named by the court. So you or your children need to get an estate lawyer to assist in getting letters of administration for the estate. Once obtained, they can present them to the landlord to gain access.
