My son was a passenger in a vehicle where the driver rolled the car and my son was injured in crash.
Anonymous5 views7 answers
The driver was 17 yrs old, he sped down a road and lost control of the vehicle. My son suffered broken leg, which required surgery, and he was airlifted to local trauma center in area.
I am now starting to deal with auto insurance of driver, does my medical need to pay everything and will we be reimbursed for this (ambulance/airlift, medical/emergency room and future physical therapy)?
Thank you.

So sorry about your boy!! You should get the best care possible, and yes have your own insurance company handle it. You will not know how much the case is worth until your boy is fully healed, and know what kind of long term issues will he be facing. Loss of enjoyment of life, past and future, will be a big part of the claim.
You will need to make sure all future expenses and damages are covered in any resolution, once you settle there is no going back for more. After you settle, have your lawyer call and reduce all medical bills owed, should not be a problem.
No question you need to find an amazing lawyer!! GOOD LUCK!!
Talk to a lawyer will the full set of facts, do not rely on this limited answer.

As you probably know by now, even a short helicopter flight to John Muir costs more than $10,000. Your son's medical bills will be significant.
You should have your/your son's health insurer pay everything now. Once your son is compensated by the responsible parties for his medical bills, your son may need to reimburse the health insurer.
It is in his best interest to seek the advice of an attorney. The driver may not have enough in insurance coverage to compensate your son. An experienced attorney will try to find other potential sources of compensation, e.g. driver's employer, driver's parents, state of California if the roadway was defective, etc.

yes, the best thing to do is to have your own medical insurance company pay the bills. that way, after the case settles, you can negotiate repayment to your own ins. co. at a lower amount as they will have a contractual lien for repayment on your son's case for all bills they paid out. you need to ensure all co-pays are paid timely though, so your credit is not harmed but you will be reimbursed for this later when case settles. if you have further questions, we do not charge people like you to talk to us regardless of length or subject matter as we would rather assist you, free of charge, so at least you are headed in the right direction rather than just leave you to your own devices without any advice simply because you don't want an attorney. please feel free to call me, dave hiden, at 619.296.5884 should you so desire. good luck.

Never try to deal with an insurance company yourself, as you will only get a nuisance settlement, as opposed to proper compensation.

Please consider doing the "right thing" for your son and yourself a favor - consult with and retain a personal injury attorney. More can go wrong than right by handling this yourself. He has sustained a very serious injury.

You can do it both ways. Preferably your insurance should pay for the bills and then later on, when you or your attorney files a claim for all of your son's damages (medical, loss of earnings, pain and suffering, etc) then you will have to reimburse your medical insurance company. A lot of times, the insurance company will discount the amount that you have to reimburse them, so it would be in your favor to do it that way.
