Can I ride a motorized bicycle (with pedals) after I got a DUI?
Anonymous2 views3 answers
Hey lawyers,
In August I got a DUI with a BAC of .025%. I am losing my license for a year because I am under 21.
Can I ride a motorized bicycle to get to and from work and school? I won't be taking any freeways or highways. I will (obviously) stay in the bike lane and obey all bicycle laws.
Looking forward to hearing from you guys!
Thanks!
Here's the CHP's position:
Motorized Bicycle (Section 406(b) VC)
Driver's License not required but rider must be at least 16 years of age.
Instruction Permit Requirements
Operator must be at least 15 1/2 years old
Operator must pass automobile written exam
Operator must pass appropriate endorsement requirements for an M-1 and M-2 endorsement
Operator must have completed an approved automobile driver education course
Note: An operator with an instruction permit may not carry passengers, ride after dark or operate a motorcycle on the freeway.
Since no driver's license is required to operate a motorized bike under 406 (b) VC- Motorized Bicycle, I believe you can. You might be eligible to apply for a critical needs license with the DMV so that you can drive your car.
Many states prohibit the operation of a motorized vehicle if your license is revoked even if a license is not requred. Thus in Illinois, you cannot drive a tractor, a lawn mower or a 4 wheeler on the public roadways with a revoked license.
