Say you left your spouse in the summer of 2010 (june) and your spouse (which is a women) waited up until now to get divorce papers and wants you to sign. What would happen if I refused or just didn't want to sign till 2 years were fully up altogether. reasons being you did try marriage consoling and they gave up, also you are no longer living together and are separated mutually. They committed online adultery which was documented and they have admitted it, which in some form is adultery if I am not mistaken. What are my options, and what should I expect if i just ignore this issue and don't sign anything.

If your wife is the one who filed, you are under no obligation to consent to the divorce. Your wife, however, can force the divorce once you have been separated for two years. It is important to note though, that the two years begins at separation, not when she filed for the divorce. As such, based on the information you provided, she can seek a divorce under 3301(d) of the Divorce Code, any time after June 2012. Once the two years have expired, this is proof that the marriage is irretrievably broken. She will need to serve you a Notice of Intention to Seek the Divorce Decree. Once she does, you will have twenty days to respond. This is your last opportunity to raise economic claims with the court. If you fail to respond during those twenty days, then she can file for the divorce to be concluded.

If you don't sign the Decree--the Court will approve it eventually anyway--unless you appear in Court and contest the divorce. There is no obligation for both sides to agree--the Court can simply put on an Order once a complaint is filed and served. Good luck.
