How can i downgrade a four point violation for improper passing to two without breaking the bank?

i was issued a ticket for improper passing and went to the court in Nj, to ascertain if it could be reduced. the State prosecutor was so miffed that i had the audacity to pose questions and demand explanations on the techicalities and fees. He now instructed that i should be issued a court summons. this is my first moving violation and i do not want this to lead to payment of a sucharge. I AM 50yrs old.
No guarantees, it is dependent upon the prosecutor, the police officer, the judge and any victims that may appear, but it is reasonable to seek a downgrade to careless driving 39:4-97 which is a 2 point violation, with fines and court costs totaling about $180.00.

DMV will not assess a surcharge for 4 points. You must have made a very bad first impression with the prosecutor because they routinely reduce 4 points to 2 points without attorneys. It is possible that the officer had a bad time with you as well and marked the ticket "no deal". I do not know what you mean by a court summons, I suspect you have been given a trial date. That is likely not the best path. An experienced criminal defense attorney can usually negotiate a 4 point reduction where a layman can only negotiate a 2 point reduction. But if the ticket is no deal figure an attorney can only get 2 points off at best.

It sounds like the chemistry between you and the prosecutor was not very good. You can retain an attorney at a reasonable fee to negotiate the best deal possible. If you are concerned about the surcharge, then you are probably not dealing with a clean license. Obviously your driving record factors into what is available.
