Is a foreign national business partner eligible for an extended work visa?

Student Visas 2 views 4 answers
would-be business partner is a Chinese national, who is here on an F-1 student visa. This person completed advanced graduate studies in June 2011, and must have a work visa by July 2012. Can this person qualify for an H1 B visa by employing herself as a partner in a professional services business? If not, are there any other visa options for this situation?

An H-1B is probably not feasible. You should retain an experienced immigration lawyer to review all the facts and advise you accordingly.

I agree with my collegue. The H visa requirements are meant to be a means of employing workers and it is not a means for people who own copmanies get visas to be in US through own company. Retain an experienced immigrationa ttorney to guide you through what options you do have. Good luck.

I agree with my colleagues, prior to making any business arrangements I would suggest speaking with a qualified immigration attorney.

You can not employ yourself and sponsor yourself for an H visa. Consult with a qualified employment immigration attorney.
