Even if your license is taken away in San Diego, can you obtain a driver’s license in a state that does "The list of states, below, indicates whether a given state belongs to the Interstate Driver's License Compact, and if so, the year they joined. Wisconsin, Tennessee, Georgia, Massachusetts, and Michigan are all non-compact states and should not share DUI conviction information." I received a DUI in San Diego and had my drivers license taken away. According to the Driver License Compact (DLC) there are 5 states where they cannot share information about a DUI conviction. Can I get a driver’s license in one of these states even though my license was suspended in CA?

Compact has to do with reporting vilations to the state that issued the license of someone who received out of state DUI. Your problem will be the national registry. When you apply in the other state federal law requires them to run a nationwide DUI search where the ca DUI may show up. Now if you have cleared the ca DUI and been reinstated there should not be a problem. If not you will have to clear it.

The best thing to do is follow what the CA DMV requires to get your license back. An interstate compact is used to exchange information about traffic related offenses for out of state drivers, and this includes DUI/DWI. Even though Georgia, Wisconsin, Tenessee, Michigan, and Massechussetts are not members, there is still the National Driver Register which is a databases of U.S. drivers who have had their licenses revoked or suspended. These are records that are maintained by the Motor Vehicle Agency of that particular state. If you were to apply for a license in Tenessee their MVA would see if your name is on the NDR Problem Driver Pointer System and investigate you further and may deny you the license based on your past Bay Area DUI.

Is your suspension for your license in CA over, but you have not completed an alcohol course in California to get your CA license back? Or are you still in the initial suspension period? If you finished the suspension period as initially required by the court and dmv, you may be able to get a waiver to allow the issuance of an out of state license even though your CA license has not been reinstated due to failure to complete a CA DUI program. There is more to this. You should contact a DUI attorney in your area to discuss this possibility.
