International student marrying a permanent resident, should we wait?

Bankruptcy and Debt 2 views 1 answers
My boyfriend(LPR granted from previous marriage) got divorced 4 years ago and now we are thinking of getting married. I entered on student visa 6 months ago to stay with him. We didn't intend to get marry soon but we want to start a family while I'm in school so we decided to get married and I will stay on my student visa. If we decide to stay in the US in the future, he will apply for naturalization and sponsor me upon his becoming a US citizen. Will the USCIS deny his naturalization because of being married to a F1 student? If he becomes a citizen, can he sponsor me without any problem?

The fact of marrying an F-1 student does not, of course, disqualify an LPR from naturalization. The requirements are that that person must be of good moral character (i.e. no immigration, criminal, tax violations, payment of child support, if any, registration in selective service, etc.) . As for you, I strongly advise to stay in school, for several reasons. As you will be able to adjust only after your husband becomes a citizen, and Immigration (ICE) monitors SEVIS system closely for F-1 drop-outs. Finally, if your husband's income is 125% above the poverty level, he should have no problems sponsoring you.
