What do I do about my prepaid vacation package when the company refuses to honor it?
Anonymous3 views2 answers
I bought a vacation package November 2009 and its valid for 5 years. I was to get 4d 3 night in Napa Valley and 2 show tickets for a 90 minutes presentation, 4d 3 nights in Anaheim and 2 tickets to go into Disneyland and 3d 2 nights in Vegas and 2 show tickets. When I tried to plan this for December 16th, 2011 I was told the Anaheim part was no longer available and asked me to change it to their Florida Disney world package. This does not make sense because I would have to pay for the 7000 mile round trip difference before I went to the Vegas destination. I asked for a refund and they refused. What do I do?
Where is the company located that sold you the vacation package?
For the company's home state, find out if the state attorney general's office has a "consumer protection" or similar department where you can file a complaint. I know that the California AG has such an office, and I have provided a link for you below.
You need to complain to the state AG's office where the company is -- not where you live or where you wanted to go. They will likely have more success pressuring the company than would an AG in another state.
Good Luck!
Sadly, the vacation package industry suffers from extensive misrepresentation and fraud. If you have any paperwork it should be reviewed closely to better understand the terms. Also, you can contact the Attorney General's office in the state where the package was sold and they may be able to provide some assistance. Assuming the company is not judgement proof, hiring an attorney may be the only practical way forward but may not make economic sense. Another option is for the attorney to draft a letter on your behalf requesting a refund. May or may not result in a different response from the company.
