How can I get the Ignition Interlock requirement waived in Florida?
Anonymous2 views3 answers
I was convicted of a DUI for the first ( and only time) about two years ago. I have completed all the requirements but according to the DMV I am supposed to get the interock installed in my car for 6 months. I have severe asthma and have been trying appeal this requirement thought the medical review board for the interlock device. So far, I have submitted my appeal 3 times and they ordered to lower the volume 1.0 liters. I am still not able to operate the interlock or get it installed. What are my options is order to get this requirement waived? I really need some advice, I haven't been able to get anyone in the DMV to help me or point me in the right direction. Should I get a lawyer?
If i were to represent u in this matter, i would file a motion with ur sentencing judge to mitigate ur sentence based on the asthma.
To be successful, we will need medical proof of ur condition. That means a signed letter, on official letter head, by ur doctor... at a minimum. We may also need ur doctor to testify on the record in the worst case scenario.
In any event, there are solutions to ur problem. Remember, the interlock was judicially imposed by the court... Not adminstratively imposed by DHSMV.
Call me if u would like my help.

A motion to waive the interlock requirement before the sentencing court would likely be your best option. As stated above, an official letter from your Doctor would be required at a minimum with a chance that he would be required to testify regarding the matter in person.
Dealing with the DMV is nearly impossible.
My offices are located in Miami. Please feel free to contact me should you decide to proceed with a motion before the court.
Best of luck.
