if all parties agree and they state in writing that if the defendants do not sign by end of the business day and deliver to attorney that the short sale is cancelled and they will proceed with foreclosure. The defendants signed and delivered as agreed and the mortgage company still put the sale in the amount to show two days after agreement signed. The sale amount increased and was sold 30 days laters. 35 days later the mortgage company filed the previous agreement. Since we kept our agreement and they proceeded with publication would this mean that the stipulated judgement is voided. they did state if it was not signed as agreed they would cancel the sale and proceed. We signed and delivered and have signed proof by the secretary. Would this be considered fraud and can we fight
