Son Caught "Shoplifting" Shoelaces at Kohl's - Now What?

Criminal Defense 3 views 3 answers
My son, 17, went to Kohl's yesterday to purchase tennis shoes. He saw a pair that had 2 pairs of shoestrings-black & blue-and thought the blue strings were cool. He took the blue strings, stuffed them in his pocket. He purchased a different pair of shoes and left. Security guard stopped him outside, accused him of stealing the shoelaces. My son was pulling out car keys-security grabbed his hand & keys, said he might be pulling a weapon. He was taken to a back room, my husband went there to take care of the situation. They were forced to sign papers, else they were going to take my son to the police station. Both my husband and son were treated very badly. Kohl's says they are going to prosecute for full cost of shoes-$64 (though they're clearance!) Is this right? How should we proceed?

The local police will likely charge your son with theft a first degree misdemeanor punishable by 180 days in jail and a $1000 fine. The value of the item is inconsequential as any amount less than $1000 is a misdemeanor and restitution will not be an issue as, presumably, Kohls recovered the shoelaces. You will need to hire an attorney. A M1 theft conviction can have ramifications that will affect your son's future. Depending on the municipality and your sons criminal record, if any, there are programs designed to punish juveniles but not adversely affect their futures. However, some of these programs must be taken advantage of early in the proceedings. Feel free to call my office with any further questions. Scott Bissell, Esq. (937) 296-0365 [email protected]

Agree with prior answer, however, you said he purchased the shoes. I presume he has a receipt that demonstrates same. This was a "no so smart move" and he appears to be guilty, but not of stealing shoes. Kohl's got their laces back. You need to hire an attorney to handle this, he may be able to get the case dropped, however your son is a juvenile and a criminal record could have lasting impacts. I would definitely seek a diversion program for your son and an attorney will be able to help you out with this.

YOU SHOULD GET A CRIMINAL DEFENSE ATTORNEY TO HELP YOU!!! THAT IS HOW YOU SHOULD PROCEED! Koh's is VERY AGGRESSIVE, and they do some things from what I hear, that is questionable at times. You may have defenses to what your son and husband signed. Moreover, you will likely receive a "Demand Letter" in the mail from an Attorney representing Kohl's, who will threaten you with a Civil Lawsuit if you do not send them $250-$300.00. I can give you more information on this if you give me a call at my office. Attorney Mark A. Deters Deters Law LLC www.TheDaytonDuiAttorney.com www.deterslaw.com 937-224-1100 419-466-8925
