I have a claim against the estate of a person who was holding some money for us and died suddenly. The amount of money is $8,950.00.

The verified claim forms are available online or at the Surrogate's Court. If the estate has been opened, be sure to use the file number of the estate so that you will be noticed of everything. If the estate has not been opened (either probate or administration), you can open it as a creditor. Sometimes this is the best way to go. It depends on the size of the estate and who will be handling the estate. Is it someone you trust or not? Just becuase you file a claim form, it does not mean that you will be paid the full amount. Depending on the amount of creditors and the size of the estate you could be paid pro rata or nothing. Depending on the circumstances, you may want to file the claim through a lawyer. It is cheap to do.
