Best plan of attack here, what do you think the chances of a lesser charge will be?

25 years old, i weight 150 blew a .12 at the station. Cop said I failed all tests, but i recieved a black eye earlier at work (freak accident) and it was negative degrees out. I did have a beer at my house after work, and then one more when i picked my buddy up from work like an hour later. I was driving down a busy street where bikers tend to ride without lights so I had my brights on, cop flicked his lights about 100 yards away coming my way I didn't immediately flick my off and he pulled the u-ey and went from there. I got pulled over less than a block away from my house.

It sounds like you think your black eye and the freezing temperatures may have interfered with some of the officer's tests. If you want the best chance of winning on those issues, you need to hire a criminal defense attorney!

There are a number of legal attacks that it seems like you might be asking about. You will need an attorney to address the issue if you want the charges completely dropped. You can apply for first offender status and may be able to do so without an attorney. I say you'll need an attorney because a lay person will have a hard time writing the arguments for lack of reasonable suspicion prior to pulling you over, and also to argue about the accuracy of the tests given the extreme cold. You may need to hire an expert for that. If you wish to challenge the pull over as unconstitutional or the tests as inaccurate, you will need to talk to a good defense attorney as soon as you can. Remember, you can always contact a public defender if you are unable to pay for an attorney. Best of luck!
