What is the difference between Temp Guardianship, Power of Attorney and Foster - Family to Family?

My husband's step-brother babies mom wants us to take their 2 kids (3&5 yrs old) she is unable to care for them at this time (father in prison). We live in Maricopa County, Peoria, AZ she lives in Kingman, different county. She did not give us a time of when she would return for the children. We were wondering if we took the children is there a way the state would help us to care for these 2 children? We have 3 kids of our own and to take on 2 more children we would be struggling. I don't want the children to be seperated. We don't know where to begin and who to talk to without having to pay to see a lawyer as funds will be tight. She is dropping kids off then returning home, what paperwork should we get and should she sign the paperwork prior to returning home?? Please help!!
If you do take the kids, you need a Power of Attorney for Minors that allows you to at least make medical and emergency decisions. You will need to document to show that you have power of attorney for the minors from the parent(s) in order to do anything with schools, hospitals, etc.
If this is going to be for a longer duration than a month or two, consider a temporary guardianship. This requires a court proceeding, but there may be a non-profit organization that can help you. At that point the court can make you temporary guardians, but the court also has power to decide if the kids will return to their parent(s).
It is not likely that the state will pay you to take the children without going through something like a foster program. You can look into that with the local agencies that handle fostering and state assistance for child care.
I hope this helps answer your question.
