The company is not paying my vacation time accrued from 2010.

I was terminated from my previous employer after 28 years of service. They paid me my accrued vacation time from 2011, but they did not pay me for the two weeks accrued from 2010. They have always paid all unpaid accrued vacation time in the past. What can I do?

This is going to turn on the company's written policy. To cut to the chase, you should ask human resources about the 2 weeks and get their position. If there is nothing in writing expressing a forfeiture of past vacation accrued, there is Florida caselaw indicating its been "earned" and you are entitled to it . . . I have seen employees recover vacation pay in small claims court.

You can sue for the back benefit if it was vested. Do they have a rules and reg manual which establishes a vested right to these benefits? More information is needed to see if you have a vested right to these benefits.
