Form to file petition for Emerg. Temporary Custody Orders?

3 views 2 answers
I need to file a petition for emergency temporary custody orders in El Paso, TX. I am not able to get a lawyer right now, so will be doing this on my own. Is there a form I should have already filled out/ created when I come to court, or is there a form/ process I should complete in the courthouse the day I want to file? Will a hearing be set for the same day? (I'm coming in from out of state for this and need to know how much time I need to prepare to be there)

You will need to find a Texas form service such as Legalzoom.com to help you fill out the proper paper work, file the petition you created with a notice of temporary hearing (set by the court), and have a citation served on the other custodial parent. Good luck.

If you file for an ex parte temporary restraining order and the judge grants it you will have temporary custody until a hearing. You will have to file a petition for modification (if there is a current order) or a petition in a suit affecting a parent child relationship. You will also have to have a temporary restraining order for the judge to sign as well as an attached affidavit if you are seeking to restrict the other parents access. A hearing on a restraining order will be set within 14 days of the request and the other side must have at least 3 days notice.
