How do get contractor to return unused payment for a job not completed?

three years ago, paid a contractor for the first third of work to build a garage (est 25K) - after just breaking ground, he ran into issues with wetlands. We learned it would cost more to change the drainage than to build the garage. We had him stop work immediately. He burned about 2-3K in hours before we stopped work. We have a contract and he owed us a refund of the remainder of our first payment (est. 22K). We tried to get a refund and he claimed he didn't have the $. We've been back and forth with him trying to find a way to have him do work against what he owes. He's been uncooperative and has paid us just one payment of 1K almost two years ago. He took our money, spent it elsewhere and didnt do the work. We're willing to spend some money if we can recoup anything.

You have a contract. You paid $22k under the contract. The other party has performed certain actions Environmental 'issues' got in the way of performance by the contractor. Exactly what IF ANYTHING you are due back from the contractor really ought to be spelled out in the contract. Be aware that the statute of limitations provisions in Connecticut (where I am NOT admitted to practice) seem particularly complex. You really will need a hand from an attorney to review the contract, consider options and help you proceed, friend.

First, the statute of limitations for a breach of contract action is 6 years for a written contract. But, when you say that he ran into a wetlands issue, it may not be his problem. Typically, an owner is responsible for making sure that the construction doesn't violate any zoning or wetland regulations unless that is the contractor's responsibility in the contract. Since you stopped the work, the contractor may argue that you breached the contract. There is a fund in Connecticut that you can recover from if your contractor was licensed, and you can't collect a judgment. The bottom line is you need to talk to an attorney familiar with construction issues.
