Can witnesses prove cash payment?

2 views 1 answers
I have two witnesses who witnessed me paying full rent to my roommate for rent at the apt he sublet to me. Lease was oral. I have rent payment receipts, but he's denying he signed them . And the investigator threatened him to sign a statement saying he did not sign rent payment receipts. His threats were a) he has a signature expert as proof. b) he threatened to have the IRS audit my roommate if he didn't "admit" to not signing rent payment receipts. other questions 1. I did sign some of the receipts after receiving roommates permission to do so. 2. witnesses were not present during every transaction, but were present to some. the investigator intends to show evidence that I lied about how much rent I paid (because I was reimbursed rent from the govt)

You do not explain who this "investigator" is, who hired him, or what he is investigating. I would not give much thought to the IRS threat. The IRS does not go around "auditing" roommates in rental disputes. Your questions are rather confusing, but any witness can testify about any matter of which they have first hand knowledge. So, if the witness actually saw you pay cash (and can say they know the amount, perhaps because the recipient counted it out in plain view), then the only question for the judge (or jury) is whether your witness is credible. If the judge or jury believes your witness, then the fact of the payment and the amount is proven simply by that witness' testimony. On the other hand, if the judge or jury believes your witness is a liar....well, then, you lose on that issue.
