Holding out on a Plea deal?

Business 3 views 2 answers
I have a friend who has been Federally Indicted for drug/gun charges. He is 19 years old. He has been told by the Pros. that should he not take the plea deal offered to him...he will throw every charge at him. That would result in him being over 50 years old at time of release. It is my friends beleif that if he holds out on a deal(until close to trail) the Pros. will go lower on the charges. Is this advisable or just ridiculous? I dont see how this is a logical way of thinking.

I agree with Mr. Epifanio. The stakes are too high in Federal Court to try to play chicken with the US Attorney to see if the deal gets better. That, combined with the strict federal sentencing guidelines does not typically get you a lower plea offer as you get closer to trial. Now is the time for you friend to have a serious discussion with an experienced criminal defense lawyer who is familiar with these issues. Either that, or your friend should get prepared for the worst, just in case. DISCLAIMER This answer is not intended to, nor does it create, an attorney-client relationship. Do not assume that the legal theories I mention that pertain to NJ will apply in your State. The facts of each case are different, and it is therefore critical for you to consult with a qualified counsel with whom you can share information which can be assessed under an attorney-client privilege, so that you can get competent legal advice from which you can make informed decisions. I urge you to immediately contact an experienced criminal defense lawyer admitted to practice in your State before making any decisions about this case.

No attorney can really answer as to whether or not this is advisable without knowing more information about the case. Your friend really needs to talk to an attorney in his local area that handles not only criminal cases but Federal criminal cases. They tend to be very complex and driven by sentencing guidelines. When it comes to Federal court there is usually little logic in how the prosecutors think so your friend needs to get an attorney now. Good luck.
