How can I get information on my husband's bank account if I'm not on it?

We were planning a big wedding this part yr so we planned on saving his unemployment checks in his savings account, which is in his name only, and we lived off my checks. He said he had the bank which is a credit union, put a lock on it and the lady put the money into a 401k account. Near the the date we were supposed to have access to the money we canceled the wedding and he told the bank we canceled. Now we have been waiting since 11/17 for the money. He tells me when he talks to them n said they said since it was in a 401k account, it'll take a while before it comes in. I want to know how much access to his account do I legally have since we have been married since 12/4/10. I want to find out myself what's going on.

Unless your name is on the bank account, you probably won't be able to secure those records, even if you're married. You may be able to subpoena those records in case of a divorce and dispute over community property, but that doesn't seem to apply in your situation.

In general, banks will not share the information if you're not on the account. If you suing someone or have a judgment against someone, private investigators may be able to obtain such information. Please visit my website - www.bgartenberg.com - or call me if you'd like to learn more about me or my practice. You can also find me on LinkedIn, Facebook and Twitter. Thank you. Kindly note and remember that my response is merely a general comment on the law related to your question, and NOT legal advice or opinion. Also, your question and my response does NOT create an attorney-client relationship between us. You cannot rely upon what I have written, because I do not have all of the information that I need to advise you or render an opinion. Even simple facts you have not shared can completely change my answer. For me to give you legal advice or opinion, you would need to hire me to be your lawyer, and then we would need to discuss this in detail and go over the documents.
