What happens when a non-custodial parent moves out of state

I currently live in the state of Ohio. Which is where my divorce and child custody was filed. I just found out that my ex husband and his girlfriend are moving to Florida on Feb. 25. Right now his visitation is every other weekend. What is going to happen with visitation? I can not afford to pay for her to go to Flordia for visitations. (I currently work full time while also going to school full time and have a younger child) Also right now our child custody says that he can not take our 3 year old out of state without my permisson. She hasnever spent more than a few days away from me and I'm afraid he will have teh extended visitation while it will upset her to be away from me for that long. ( I let him have her for a week for vacation time last summer and she was very upset)

First I would look to what your divorce decree and or parenting plan says with respect to one parent or the other moving out of state. Generally, one is not expected to let a 3 year old have extended visits or parenting time, with a parent who has not been a primary caregiver. Nor (unless your court order says otherwise) would you be expected to cover the costs of Dad's parenting time. Were Dad to take you to court over a refusal to permit an extended interstate visit, the court would look at a numeber of factors found in Revised Code 3109.04. Attached are articles I wrote on the factors a court looks into in determining the best interests of a child, and divorce and kids. Please vote this answer up if you found it helpful.
